The « chineindigo » Website is provided to your personal use subject to these Terms and Conditions. By using the Website you agree to be bound by these Terms and Conditions.
We reserve the right to update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Website. In which case, the Conditions to appply would be those in effect at the time of order.

Prices
The price of the products are shown in euros, are inclusive of VAT, and do not include delivery charges (which charges will be mentioned during the order taking preocess and will be added to the price of the products). Chineindigo reserves the right to modify the prices anytime, but the products will be charged on the basis of the prices in effect at the time of the order taking.
Availability of products
Chineindigo will make every reasonable effort to ensure that the products are available. Availibility of ech product is indicated on the site. However, if by mistake, or in the exceptional case that, despite this indication, a product cannot be available after an order taking, Chineindigo will inform the buyer as soon as possible of the delivery date. The buyer will then be able to cancel it's order, which will be reimbursed in case the payment will have already been made.
Order
An order will be accepted by Chineindigo after reception in full of the payment (including delivery charges corresponding to the geographical area of delivery). Chineindigo reserves the right to refuse any order from a customer with whom there is a dispute concerning payment of a previous order, or doubts as to whether the buyer is serious (for example, delivery to a foreign Post office box)
Terms of delivery
The products will be sent to the address indicated by the customer on the purchase order.
The adress taken into account is the buyer's address unless the buyer has specifically entered a different delivery address. Delivery charges displayed during the process of order are calculated for metropolitan France ; for any delivery outside this area, the buyer will contact direclty Chineindigo my mail, in order to receive the appropriate delivery charges, which will need to be added to the price of products.
For international deliveries and outside metropolitan France, the buyer agrees to comply to the import laws applicable in the country of destination of the order.
The order will be preapred promptly, generally speaking within two or three working days, excepted in case of exceptional closure postponing the deliveries, in which case the site will provide the information. Chineindigo will inform the buyer by at the time the product is shipped, and, whenever available, will communicate a code allowing him to follow up the parcel on the Post Office internet site.
Delivery issues
The customer is responsible for verifying the condition of the parcel when it is delivered. Any reserves (parcel opened, damaged,…) will need to be written down on the delivery note and duly signed by the customer. In case of damage, the reserves will need to be notified on the delivery note, together with the customer's signature and in case of damages on the goods, the customer will need to formulate a complaint motivated with the carrier by recommanded letter, and send a copy to Chineindigo. Failure to assert any claims at the time of reception of the parcel does not deprive you from the legal guarantee of conformity related to the product (see further below).
You have the right to cancel without cause within 14 days. The cancellation period ends 14 days after you, or a third party that the carrier and yourself, have physically handled the last object ordered.
To exercise the right of cancellation, you will need to notify us of your decision to cancel the present contract via a statement void of ambiguity (for example, a letter sent via postage to Chine Indigo, 1 rue casimir mouton 13640 La Roque d'Anthéron or via email to [email protected]). You can also fill out and send to [email protected] the template for the form of cancellation you can find here attached. If you use this option, we will reply without delay with a cancellation confirmation receipt via email.
So that the period of cancellation is respected, you simply need to exercise your right of cancellation before the expiration time.
In case of cancellation from your part, we will reimburse you all payments received by you, including delivery fees (at the exception, as the case may be, of extra costs, if that was your decision or choice, coming from a delivery other than the least expensive delivery choice proposed to you) without excessive lateness, and, at all events, at the most fourteen days from the day we are informed of your decision to cancel on our present contract. We will reimburse you using the same payment method used for the initial transaction by you, unless you explicitly ask for a different method; at all events, this reimbursement will not entail any fee on your part.
You will need to send back the items to Chine indigo, 1 rue Casimir Mouton, 13640 La Roque d'Anthéron, without excessive delay and, in all events, at the latest after 14 days after having signaled your decision to cancel. This delay is esteemed as respectable if you send the items before the 14 days. You will need to take cover the direct fees for the return of the products.
Warranty
We warrant our jewerllry against defects in compliance with article L.217-4 and subsequent ones of the French Consumer Code and against all hidden faults in compliance qith the articles 1641 and following of the French Civil Code. (See insert below).
Any request on that regard can be sent to SAS HB, 1 rue Casimir Mouton, 13640 LA ROQUE D'ANTHERON, FRANCE, in his capacity as guarantor of the conformity of it's jewellrey.

Legal guarantee ofr conformity
The seller is liable for the lack of conformity of the goods under the conditions provided for in Article L.217-' and subsequent ones of the French Consumer Code, and for the hidden defects as per under the conditions provided for inArticle 1641 and subsequent ones of the French Civil Code. When acting with regards to the legal guarantee of conformity, the buyer : - can act within two years as from the delivery of goods ; - will be entitled to choose either the repair or the replacement of the goods, uneder reserve of the costs conditions of Article L217-9 of the French Consumer Code. - is exempted from supplying profof of the conformity defect of the good duing the twenty-four months following the delivery ot the goods, excepted for second hand goods. - can decide to obtain guarantee service for hidden defaults of the object sold as per the Article 1641 of the French Civil Code, in which case he is entitled to choose either the cancellation of the sale or a price reduction in accordanc with the article 1644 of the French Civil Code. Legal guarantee of conformity applies independently of an eventual commercial guarantee. |
Dispute settlement
Sales concluded with SAS HB (ChineIndigo) or via the Website www.chineindigo.com are subject to French Law. In the event of dispute, an amicable solution will be sought before any legal action.
To that effect, in accordance with the legislation, we are affiliated to an an accredited mediation service.
This means that in case of a dispute remaining unsolved by contacting us directly, you have the possibility to submitt this dispute to our mediator :

In case the mediator's opinion does not satisfy either Party, all disputes and their consequences will be governed by French law. French courts and tribunals will be the only competent ones, and will be selected according to Article 631-3 of the French Consumer Code.
Data protection
Every data given by the purchaser to the seller is strictly used to treat the order.
Every purchaser has a right to access, modify or remove personal data provided to SAS HB.
Conditions of use of this site
The website Cbhineindigo, designated hereafter by the ter 'the Site', is offered to you under certain conditions of use, defining the relations between you and the Site. These conditions of use are defined hereunder and the mere use and/or consultation of the Site implies, automatically and unconditionaly, your full acceptance without any reserve of the conditions of use.
The Site reserves the roght to modify the present General conditions of Use at any point in time without prior notice or compensation in any form whatsoever. Thus, we advise you to read them regularly.
Intellectual property.
The content of the Website (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos) is protected by copyright, trademarks, database right and other intellectual property rights, and belongs to SAS HB. You may retrieve and display the content of the Website on a computer screen, store the content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute, or use for commercial purposes, any of the materials or content on the Website without our written permission.
Except to the extent expressly set out in these Terms and Conditions, you are not allowed to:

create links to the Website from any other website, without the prior written consent of SAS HB, although you may link from a website that is operated by you provided the link is not misleading or deceptive and fairly indicates its destination, you do not imply that we endorse you, your website, or any products or services you offer, you link to (and do not frame or replicate) the home page of our website, and the linked website does not contain any content that is unlawful, threatening, abusive, libellous, pornographic, obscene, vulgar, indecent, offensive or which infringes the intellectual property rights or other rights of any third party.
Except as expressly set out here, nothing in these Terms and Conditions gives you any rights in respect of any intellectual property rights owned by SAS HB and you acknowledge that you do not acquire any ownership rights by downloading or using any content of the Website.
Any illegal use of the whole Site or part of it (piracy, counterfeiting) may lead to legal proceedings.
Personal data.
The Site may collect some certain name specific information concerning you.
These information are used by ChineIndigo. However, ChineIndigo reserves the right to communicate these information to third parties.. If you disagree with this possibility to communicate your data, you may refuse it, as well as access, rectify or cancel the information concerning you, in accordance with the French law of 6 January 1978 that pertain to information technology, databases and civil liberties, by contacting [email protected].
Eventual links to other Web sites.
The Site may contain hypertexts links providing access to other Websites published and managed by third parties and not by ChineIndigo. ChineIndigo cannot be hold hold directly nor indirectly responsible in the ase these third party sites wouls not respcet the legal rules either Frech or European, in effect or to come, as well as the consequences of this non-respect.
Guarantees.
Subject to the applicable regulations, you expressly recognize and accept that the Site is provided « as is », accessible according to it's capacities and wihtout any express or implicit guarantee from ChineIndigo, and that it's use is done at your own risk, under your entire responsibility. ChineIndigo does not guarantee that (i) the Site, the contents and products offered will perfectly match your needs, (ii) the Site will operate without interruption and will be exempt from any mistake, that these interruptions or mistakes will be corrected, (iii) the Site will contain no virus. Any material downloaded and/or obtained, by any means, during the use of this Site is at your risk.ChineIndigo will be in no way held responsible for damages, loss of data suffered by your computer. Limitation of liabilty.
Subject to applicable statutory or regulatory provisions, ChineIndigo cannot be held responsible for any direct or indirect damage, including but not limited to, loss of profits, of customer base, data bases, intangible assets, that could result from the use or the impossibility of use of the Site, and generally speaking of any event linked to the Site and/or any third party Site.
In particular, ChineIndigo shall not be held responsible in case of total or partial piracy of the Site and of damages that this piracy could create to you or to third parties.
Closure or suspension of the Site
ChineIndigo sreserves the right, whenever she wishes, to modify, interrupt temporarily or permanently, part of entirity of the Site, without warning nor indemnity whatsoever. In no case can ChineIndigo be held responsible towards you or any third pary of any suspension, interrruption or modificaiton of the Site.
